Definitions
- “Offer” — these Terms of Service.
- “Service” — the Smurfarium online platform (website) owned by the Provider and intended for the sale of Goods.
- “User” — any individual who has accepted this Offer.
- “Goods” — high-level game accounts listed on the Service.
- “Acceptance of the Offer” — payment via the Service; full and unconditional consent to these Terms.
Subject of the Offer
- The Provider delivers the Goods as selected and paid by the User; the User accepts and pays under these Terms.
- Smurfarium is an independent marketplace, not affiliated with publishers nor an official representative of any game or platform.
Payment and Delivery
- Price and parameters are set in the Service UI before payment.
- Payment: 100% prepayment via supported methods.
- Upon confirmation, the Goods (account credentials) are delivered automatically or within an agreed time frame.
- The User is responsible for data accuracy and access delivery address. In case of errors/discrepancies, delivery is deemed completed; no refund unless expressly stated.
Refunds and Cancellations
- No returns for Goods of proper quality. After successful delivery of access, the service is fully rendered; no refund.
- Refunds only if:
- Total non-performance: paid Goods not delivered — 100% refund.
- Partial performance: account not as described — Provider supplies missing parameters or refunds the proportional part.
Rights and Obligations
The Provider shall:
- Deliver the Goods under these Terms.
- Maintain the Service and provide support.
- Not disclose personal data except as required by law or the Privacy Policy.
The User shall:
- Read these Terms before acceptance.
- Provide accurate data for delivery.
- Use the Goods according to rules/policies of the respective games and platforms.
Liability and Force Majeure
- The Provider is not liable for the User’s subsequent use of the Goods, including deductions, bans, or other actions by platforms/publishers.
- Parties are released from liability under force-majeure circumstances.
- Force majeure: global Internet outages, platform failures, government actions, blocking of services, and other events beyond control.
Dispute Resolution
- Disputes are settled by negotiation; support contacts are available in the Service.
- Failing amicable settlement, disputes are resolved in court under applicable law.
Term
- These Terms take effect upon publication and remain until revoked by the Provider.
- Amendments take effect upon publication of a new version.
